TERMS

 

Palucraft (Pty) Ltd (“Palucraft”) provides an online platform, palucraft-gccstudy.com, its sub-domains & social media pages (“Website”), that shares information about Government Certificate of Competency Factories (“GCC”) to the Website users/visitors (“Users”). The GCC information relates to the application process, requirements and tips on how to succeed in obtaining the GCC.

 

Palucraft also provides a license to access Study Material (“Product”) on the Website’s other sub-domains. The Websites sub-domains host the Candidate platform which allows access to the Product.

 

The Product is designed for the purpose of preparing for the GCC Plant Engineering and OHS Act Exam. The Product is provided to Candidates who make a purchase of the Product through the Website or otherwise authorized by Palucraft management.

By accessing the Website and Product, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws.

 

If you do not agree with any of these terms, you are prohibited from using or accessing the Website and Product. The materials contained in the Website & Product are protected by applicable copyright and trademark law.

 

These Terms & Conditions are entered into by and between Palucraft and its the Users and Candidates of the Website and should be read together with the Privacy Policy. Your use of the Website, Product and/or content contained therein constitutes your agreement to be bound by these Terms & Conditions.

 

1. USE LICENSE & PERMISSIONS

 

Permission is granted to temporarily download, where to download option is provided, one copy of the materials (information) and access the Product, where a purchase is done or otherwise authorized by Palucraft Management, on the Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

• modify or copy the materials;

• use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

• attempt to decompile or reverse engineer any software and Product contained on the Website;

• remove any copyright or other proprietary notations from the materials;

• transfer the materials to another person or 'mirror' the materials on any other server;

• Share your login details with another person(s), group or organization. Access to the Product is for the sole use of the Candidate who has made a purchase of the Product and information from the Website.

 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Palucraft at any time.

 

Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. Palucraft Shall also remove you a member of the Website and Product.

 

The content on the Website and Product, including all information, software, technology, data, logos, marks, designs, text, graphics, pictures, audio and video files, other data or copyrightable materials or content and their selection and arrangements (“Content”) uploaded or transmitted by Palucraft is and remains Palucraft property. The candidate is only granted a license to use the Content for its intended purpose.

The content is protected under the South African intellectual property laws and any foreign jurisdiction where the Website and Product are accessed.​

2. THE RELATIONSHIP BETWEEN PALUCRAFT AND CANDIDATES

Palucraft provides an online platform upon which Palucraft offer for sale the Product to Users. Palucraft is the Product Provider. Palucraft is not an educational institution. The Product is provided to Candidates for use at their own time and under no supervision by Palucraft and any of its representative. The Product is for self-study by the Candidate via the Website where the Product is hosted.

3. CODE OF CONDUCT

In using the Website and Product, you must behave in a civil and respectful manner at all times. The following is prohibited:

• Act in a deceptive manner by, among other things, impersonating any person;

• Harass or stalk any other person(s);

• Harm or exploit minors or other Users or Candidates; or

• Distribute “spam”.

Palucraft has the right, but not obligated, to monitor all conduct on and content submitted to the Website.

This license shall automatically terminate if you violate any of these restrictions and you may be terminated by Palucraft at any time. 4. PRODUCT PRICING AND REFUNDS

5. GUARANTEE POLICY

​

We do not offer a refund on any of our products. This is because our products are digital products and printed books which are difficult to receive in original form without the end-user consuming the content.​

6. REFERRAL POLICY

​

Palucraft GCC Study does not have a referral programme.

7. DISCLAIMER

​

The materials on the Website are provided 'as is'. Palucraft makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Palucraft does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Website and Product or otherwise relating to such materials or on any sites linked to the Website.

 

Palucraft or any of its divisions are not an official service provider or affiliate of any government or educational institution.

 

Palucraft or its divisions’ resources are not approved or endorsed by any government or educational institution. The content on the Website does not guarantee that you will pass your GCC Factories Exams; the intent is to assist you in better preparing for the GCC examination written in South Africa; however, dedication on completing all the content in the Website and Product may increase your chances of passing the GCC Factories Exams.

8. LIMITATIONS

In no event shall Palucraft or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Website and Product, even if Palucraft or a Palucraft authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

9. REVISIONS AND ERRATA

 

The materials appearing on Website and Product could include technical, typographical, or photographic errors. Palucraft does not warrant that any of the materials on the Website and Product are accurate, complete, or current. Palucraft may make changes to the materials contained on the Website and Product at any time without notice. Palucraft does not, however, make any commitment to update the materials.

Palucraft has not reviewed all of the sites linked to the Website and Product and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Palucraft of the site. Use of any such linked web site is at the user's own risk.
